Tom Fitzpatrick's Recoveries

March, 2011 - Trial in Circuit Court for intentional interference with inheritance. Represented three siblings in suit against a fourth sibling who allegedly misappropriated money from her mother's accounts. Obtained judgment in favor of clients in an amount in excess of $189,000.00.

March, 2011 - Jury Trial in La Crosse on behalf of Hmong lady whose knee was injured in a motor vehicle accident. Medical bills were approximately $5,000.00 and she offered to settle for $11,000.00. The defendant, American Family, only offered to pay $1,400.00. We obtained a verdict and recovery for $59,027.00.

September, 2011 - Jury Trial in La Crosse Circuit Court for a young lady who sustained a soft tissue neck injury in a motor vehicle accident. We offered to settle for $50,000.00. Defendant American Family offered to pay $40,000.00. We obtained a judgment and recovery for $76,111.00.

February, 2012 - Trial in La Crosse Circuit Court, our client was a young woman who sustained a soft tissue injury to her neck, but also developed abdominal problems because of the pain medication she was taking for her neck. We offered to settle for Allstate's policy limits of $100,000.00. Allstate offered nothing. We obtained a judgment and recovery from Allstate in the amount of $103,348.00.

January, 2013 - This was a jury trial for a young girl who was bitten by a dog. Although she did not end up with a visible scar, the insurance company only offered to pay $8,500.00 because she only had incurred $2,400.00 in past medical expense. We offered to settle for $20,000.00 and obtained a verdict and total recovery of $26,832.00.

September, 2013 - We represented a middle aged lady who sustained an injury to her neck in a low impact car accident in which she was rear ended. Ultimately she has surgery to her neck, but the insurance company denied that the surgery was related to the accident because there was very little damage to either vehicle. As a result, the defendant, Farmers Insurance only offered to pay $10,000.00. We obtained a verdict for $97,169.00.

Cases involving both workers compensation claim and personal injury claim:

Semi tractor driver struck head on in Minnesota by a pickup truck going the wrong way on the interstate. Semi driver sustained an injury to his wrist and muscle strain to his back. Had to retire from truck driving a few years earlier than planned. In addition to workers compensation insurer paying all of his medical bills, including future bills for medication, we recovered $124,000 in workers compensation benefits for him, $100,000 from the pickup driver's insurance company, and an additional $80,000 for our client's employer's underinsured motorist carrier.

Pickup truck driver from Wisconsin was doing roofing work in Minnesota, and was rear ended on the interstate north of Minneapolis, causing low back strain. He could not return to roofing work. In addition to the medical bills paid by his workers compensation insurer, workers comp voluntarily paid him $22300 in benefits. We obtained an additional $50,000 in workers' comp benefits, $100,000 from State Farm which insured the other driver, and $95,000 from the employers' underinsured coverage.

Driver of garbage truck was struck in right front tire by a vehicle passing on the left in a residential area of La Crosse, causing the truck's steering wheel to spin fracturing the right thumb of the garbage truck driver. After the thumb healed, he was going through work hardening when he herniated a disc in his low back leading to three surgeries. In addition to recovering over $470,000 in medical expenses paid by the workers compensation insurer, we recovered over $248,000 in disability benefits, and $650,000 from State Farm which insured the vehicle that hit the garbage truck's front tire.

Factory worker's shoulder injured by an employee of an independent contractor. In addition to collecting over $286,000 in workers compensation benefits and medical expenses for shoulder surgery, we recovered an additional $285,000 from the insurer of the employee who caused the injury.

Recent Recoveries for Children

Motor vehicle struck 15 year old boy on bike in middle of a residential street, fracturing the boy right arm and leg. Despite serious liability issues, we were able to recover the policy limits of $50,000 from Allstate, the insurer of the motor vehicle, and an additional $20,000 from the underinsured carrier.

Eleven year old girl was struck while riding her bike in a crosswalk by a pickup with a windshield partially covered by frost. Girl sustained a broken leg, but not permanent injury after the leg healed. We recovered $150,000 policy limits from American Family which insured the pickup, and $50,000 from the underinsured carrier. Much of the recovery was put into a structured settlement which will pay for the girl's college education.

Six year old boy was playing in sand on the edge of a county road when struck by a pickup truck. Boy sustained a fractured femur and emotional trauma. Incurred about $75,000 in medical expense. We recovered the policy limits of $250,000 much of which was put in a trust for the boy's future education.

Teenager was attending an extracurricular outing when his face was burned from small explosion. He made a very good recovery with no visible scars. We recovered $60,000 for him.

Recent Dog Bite Injuries

Five year old girl was visiting her grandmother when bit in the face by a neighbor's dog. Plastic surgeon said the girl would need three additional surgeries as she got older to correct the deformity on her face. Case settled for the dog owner's $100,000 policy limits, and $85,000 from the grandmother's homeowner's liability policy.

Four year old girl was bitten in the face by neighbor's dog and incurred approximately $16,000 in medical bills. The girl may need some scar revision surgery in the future. Case settled for $85,000 much of which was put into a structured settlement.

Motorcycle Accident Cases

Wrongful Death of motorcycle rider occurred when a truck turned left directly in front of motorcyclist. We recovered almost $2,000,000 for the survivors.

Bus turned left in front of young man on motorcycle resulting in fractured arm. We recovered $110,000 for the motorcyclist.

Recent Slip and Fall Cases

Semi-retired gentleman stopped at a convenience store for coffee, slipped on ice in parking area next to his car, and broke his leg. Recovery was $50,000

Middle aged gentleman was walking to his car in restaurant's slippery parking lot, slipped and injured low back. We recovered $75,000 despite serious liability problems.

Recent Auto Accident Cases

Passenger in car that pulled out in front of a truck sustained an serious injury to her shoulder requiring surgery. Incurred substantial medical expenses as well as permanent disability and limitations concerning use of her arm. Case settled for $365,000.

Farmer's cows escaped inadequately fenced pasture and ran in front of our client who was driving on a county road in western Wisconsin. He sustained a serious injury to his hand requiring surgery and preventing him from returning to work. Case settled for $225,000.

Passenger in husband's vehicle was t-boned by vehicle that failed to yield. Passenger sustained soft tissue injury to neck and injured her hip. Insurance company and her doctor said hip problem pre-existed the accident, but her doctor agreed the accident made the hip symptomatic requiring surgery. Case settled for $150,000.

Defendant turned left in front of our client who was traveling on a county road. Client sustained an injury to his shoulder requiring surgery while client was laid off from his manual labor job. Case settled for $90,000.

Fifty year old woman T-boned young man who ran a stop sign in residential area of La Crosse. Our client broke her hand preventing her from working for six weeks and lose $4200 in wages. She incurred about $25,000 in medical bills including surgery. We obtained a judgment against Allstate for $150,000.

Middle age woman was traveling on a county road at highway speed when the defendant pulled out in front of her. Collision resulted in fracture of her left wrist, and bruising to her chest and left knee. Because of the fracture she lost approximately $4000 to $5000 in wages. Case settled for $88,000.

Extremely Serious Medical Malpractice Cases

Settlement for approximately $12 million against doctor who over-prescribed opioids to a female patient with a soft tissue injury to the muscles at the base of her neck. He placed her on 12,000 mg of morphine per day, and subsequently reduced that to 9600 mg while he also put her on 2200 mg of methadone per day. Not even any defense expert had ever heard of anyone being prescribed more than 2000 mg of morphine per day, and one of the leading methadone experts in the country had never heard of anyone being prescribed more than 300 mg of methadone per day. The result of these extraordinary doses was diffuse brain damage requiring our client to have 24 hour care in an institution for the rest of her life. Her past medical expenses were in excess of 1 million dollars. Her annual care was estimated to cost approximately $300,000. Because she was initially injured while working the workers compensation carrier remains potentially liable for her ongoing medical expenses after its share of the settlement is consumed by her ongoing care expense.

Lady in her late forties was rendered partially quadriplegic by a neurosurgeon who damaged nerves in her cervical spine during surgery. As a result, she was unable to ever return to work, had difficulty walking even with a walker, and difficulty using her arms and hands. The case settled for a confidential amount in the multiple millions.

Dave Fitzpatrick's Recoveries

In 2001 the plaintiff was injured when walking across the street in a marked crosswalk when struck by a motor vehicle. The driver was insured by Progressive and the driver's parents had an umbrella policy through State Farm. The plaintiff had an underinsured policy with State Auto Ins. Co. The plaintiff suffered a traumatic brain injury, incurred substantial medical bills, and had a substantial loss of earning capacity. We obtained a life care plan to calculate the cost of future care. Progressive tendered the policy limits of $100,000, State Auto tendered the policy limits of $150,000. State Farm ended up tendering the policy limits of $2,000,000. The total settlement was for $2,250,000.

In 1999 a worker injured his back at work resulting in permanent disability. The claim was settled with Travelers Property Casualty on a Limited Compromise for $174,000, leaving open future medical bills and a Medicare Set Aside Agreement funded by Travelers. A subsequent Bad Faith claim was made and settled for an additional $35,000.

In 2004 a 5 year old female was attacked by a dog and suffered a dog bite to her face. She had permanent scarring and significant medical bills. A settlement was reached for an annuity of $100,000.

In 2004 I represented 2 people from one automobile that were injured when a car crossed the median and struck the plaintiffs. Both suffered serious injuries. One remained in a nursing home for several months after the accident. The insurance company paid $200,000 for one client and $250,000 for the second client.
