Could you be at fault in your car accident?

If there is one thing that we know about car accidents, no one likes being part of them. However, when potential clients come to us, they universally want to know that their rights and options are; especially if they believe that they were not at fault. Proving fault (in some cases) can be an arduous process. However, there a few accidents where fault can be proven without much evidence.

This post will identify a couple of accidents where fault can be proven relatively easily.

Rear end collisions – When a person is “rear ended” more likely than not the person who hit the other driver from behind is at fault. After all, the law requires drivers to keep a safe distance from the car in front of them. As such, a rear end collision may be indicative of a driver not using reasonable care by keeping a safe distance.

Left turn accidents – If a driver is struck while making a left turn by a driver coming at him or her, chances are that the car making the turn is at fault. After all, when making a left turn (especially at a traffic light) the car crossing through the intersection typically has the right of way. This means that the turning vehicle must yield until the vehicle passes, so that the vehicle does not turn directly in front of the driver.

Of course there are exceptions to these general rules that would shift liability or reduce an injured party’s compensation in the event it is found that both drivers are at fault. If you have questions about your rights or options, an experienced attorney can help.
