Fatal crash kills Lake Delton woman

When a person is killed in a car accident, the victim's family must cope with unexpected expenses. Funerals, medical bills and other fees can mount quickly. Additionally, family members may need to take unpaid time off of work to tend to their emotional needs. If the victim was a parent, childcare options will need to be arranged so the other parent can return to work. After a fatal car accident, surviving family members in Wisconsin should know that our state has laws that are designed to help them.

On Aug. 11, a car traveling west on Highway 23 in Lake Delton collided with a car traveling east. According to police, the westbound car crossed the center dividing line, apparently while attempting to pass another vehicle. The driver of the westbound car, a 27-year-old man, was being treated at UW-Hospital in Madison. The other driver, a 22-year-old woman, was taken to St. Claire Hospital in Baraboo, but she did not survive. There were no passengers in either vehicle.

In car accident litigation, tremendous importance is placed on whether a driver was guilty of negligence. If it can be shown that a driver's negligence resulted in injury or death, then the victims or their families are entitled to compensation for damages. Even in crashes in which fault would clearly seem to fall on one driver, careful litigation is often necessary to ensure that the negligent driver or his or her insurance company is held accountable..

In this particular case, since it appears the male driver crossed the center line, the family of the deceased young woman will likely have grounds to sue. But insurance companies are notorious for denying claims, even when a driver's negligence clearly caused a crash. Families confronting this frustrating situation are best served by seeking experienced legal counsel.
