Family believes Wisconsin drowning was more than accident

Facing the loss of a loved one, particularly a child, is never easy. When the loss is so unexpected, the shock and emotional impact can be great. In the summer of 2011, a Wisconsin family lost their 21-year-old son in what's been classified as a drowning accident.

They believe that the negligence of someone who was with their son at the time of the incident contributed to the loss, however, and that he should be held accountable for his actions. The parents have filed a wrongful death lawsuit against the defendant that seeks an unspecified amount in damages.

Most of the details of the incident and the lawsuit's allegations are not disclosed. Sources do report that the drowning victim was swimming while under the influence of alcohol. His blood alcohol concentration was significantly high, a point that certainly could have contributed to a drowning.

Why would the parents be targeting someone for the wrongful death? This is mere conjecture, but the parents could believe that the defendant's action or inaction led to their son's death. Perhaps the defendant was responsible for getting the victim intoxicated. Perhaps there was foul play in the water. Perhaps the defendant was in a position to help but failed to reasonably do so.

This is a Wisconsin case that currently has more unanswered questions than answered. It's clear that the system is not filing any criminal charges as a result of the drowning. Just because that's true doesn't mean that a civil lawsuit can't or won't be successful.
