Wisconsin group home blamed for choking death

The mother of a 49-year-old brain-damaged woman filed suit after her daughter died in a Wisconsin group home after choking on a bagel. The wrongful death suit claims that the group home's operators knew the woman was a choking risk but did not follow protocols to keep her away from food that would be dangerous to her. The suit seeks an unspecified amount in damages.

The mother's suit alleges that staff at the group home knew the woman ate her food too quickly and had to be reminded by workers to slow down and fully chew her food. The suit said she was put on a special diet but was known to steal food from the kitchen. It is alleged that the woman was unsupervised for an unknown length of time but long enough for her to find peanut butter and bagels and eat them quickly. When the woman began choking on the bagel, she reportedly ran back to her bedroom in the home, where she fell to the floor and died.

The 49-year-old woman had been brain-damaged since birth, when she spent too long in the birth canal and her brain was starved for oxygen. This resulted in the baby becoming developmentally disabled and mildly mentally disabled. She also was diagnosed with schizo-affective disorder when she was older, according to the suit. A lawyer for the group home denied the allegations and had filed a motion to dismiss the lawsuit.
