Wisconsin parking garage wrongful death trial won't be delayed

Attempts to delay a trial which was set to determine who was at fault in a parking garage incident that killed a teenager and injured two others was rejected by a Wisconsin judge. The judge said it would be unfair to halt jury selection for the trial addressing the fatal accident in order to give the defendant more time to investigate whether a tow truck driver had struck the parking structure's wall two weeks before a 13-ton panel gave way.

The company on trial for the accident asked for the delay, maintaining that they had just recently been able to contact witnesses who said they saw a tow truck near the panel before the collapse. According to media reports, they had requested the extra time so that they could take sworn statements from the drivers of two tow trucks. The judge said that he recognized that this would be significant for the defendants, but noted that their lawyers had more than two years to collect evidence. Further, the judge said that the company would be able during the trial to put forth any such evidence.

The family of the 15-year-old killed in the incident as well as the families of the two people hurt in the 2010 accident were suing the company that installed the panel. Also named in the suit was Milwaukee County, since it owned the parking garage.
