1 dead after drunk driver causes accident

The penalty for drinking and driving in Wisconsin can be a stiff one, especially if the drunk driver causes an accident. Despite the risks of hurting innocent people and going to jail, all too often drunk drivers don’t think it will happen to them and that they are okay to drive. Since alcohol can impair your decision making skills, it is important to have a designated driver before you begin drinking so you don’t have to worry about it later.

Having a designated driver may have not only saved one drunk driver a potential jail sentence, but it may have also been able to save the life of an innocent victim. In December 2012, a drunk driver ran a red light in Jackson County, Wisconsin and crashed into another car. The driver of the other vehicle was injured and his passenger died as a result of the car accident.

The 35-year-old man had over twice the legal blood-alcohol level in his system at 0.185 percent. He was charged with causing injury by the intoxicated use of a vehicle and felony homicide. He could face up to 22 ½ years behind bars and pay up to $125,000 in fines. His lawyer is currently trying to get the charges dismissed because he says the man cannot help in his defense because of the severe head injuries he sustained in the accident.

Although the future of the criminal charges are still up in the air, the family of the passenger killed in this accident and the driver who was injured may wish to speak with an attorney about filing a civil lawsuit against the man.
