Man hit by truck while retrieving luggage

After leaving his vehicle to retrieve something in the road, a 19-year-old man suffered a life-threatening head injury in Rock County, Wisconsin on Jan. 1. According to the State Patrol, the Georgia man was driving north along the Interstate 39-90 when he stopped his vehicle along the shoulder of the road. He then stepped out of his vehicle to pick up what is being described as some type of luggage or bag that was in the road.

The man walked across the highway when he was hit by a semitrailer at approximately 10:49 a.m. The driver was unable to stop in time to avoid hitting the individual. The impact pushed both the truck and the man in the road to the right shoulder of the Interstate. The man was taken to a nearby hospital with catastrophic injuries to the head. Following the incident, one lane of the Interstate was closed for just over an hour.

Depending on the circumstances, a case like this may result in a personal injury claim being filed against the driver of the semitrailer. If the man recovers from his injuries, he may be able to seek accident compensation for medical expenses, rehabilitation and any other long-term care he may need as a result of the injuries he suffered.

If the man dies as a result of his injuries, his surviving family members may be able to file a wrongful death claim, which should involve some type of negligence. Proving negligence in a case like this would depend on the outcome of a police investigation along with any witness accounts of the incident. A Wisconsin attorney could assist with determining whether an individual has a valid personal injury claim.
