Wisconsin deputy may face wrongful death suit

A deputy from the Fond du Lac County Sheriff's Office is now facing charges of failing to drive safely and speeding, as well as a $1.5 million civil suit, in relation to a 2012 accident that resulted in a fatality. According to reports, the deputy was responding to a reported hit-and-run accident when he crashed into a another vehicle driven by a 20-year-old Wisconsin man.

According to the Wisconsin State Patrol, the deputy did not have the squad car's siren or emergency lights activated at the time of the fatal accident. The 20-year-old was killed at the scene as a result of the impact. According to reports, the man's vehicle was flipped onto its roof and came to rest in a cornfield.

The 32-year-old was scheduled to appear before a Fond du Lac County Circuit Court judge on March 31 and faced monetary penalties of $326.50 for the failing to drive safely citation and $225.70 for speeding. The District Attorney in charge of the case said there would not be any additional charges. The 32-year-old has also agreed to pay $14,000 to the victim's family for out-of-pocket expenses.

The deputy is also named as a defendant, as well as Fond du Lac County and the Sheriff's Office, in a civil suit filed by the 20-year-old's parents. The parents are seeking $1.5 million in damages, and the trial is set to begin Jan. 12, 2015. Whether or not the parents receive that amount will likely depend on whether or not neglect of responsibilities can be proven on the part of the deputy and the county.
