Car surfing leads to man's death

Car surfing is not for the faint of heart. The notion of riding on the roof or the trunk of a moving car is something that professional stuntmen would practice for a scene in a movie. However, an 18 year-old-man has passed away after a car surfing incident in western Wisconsin.

According to WCCO.com report, the man fell off the vehicle and suffered multiple head injuries. Police indicate that the man went home after the accident and explained that he had been assaulted by several people at a local high school. Upon going to the hospital, doctors found that his injuries were not consistent with an assault. Instead, they were the types of injuries that would be sustained in a car accident

Police also found that the man had consumed alcohol prior to the accident.

The story is an important reminder of how a person who contributed to an accident may have their recovery (if any) reduced under the doctrine of contributory negligence. Like the name says, if it is found that the plaintiff in a personal injury case was more than 50 percent responsible in causing their own injuries, they could be denied any recovery at all. This likelihood is why accident investigations are very important.

In the meantime, it remains to be seen whether the man's family will pursue a wrongful death lawsuit against the driver of the car. It is also unclear whether the driver will face criminal charges (which could lead to a civil suit) based on the circumstances.
