Texting suspected in fatal crash involving Bruce Jenner

If you are the parent of a teen driver, you have probably talked to them ad-nauseam about the dangers of distracted driving; especially about what can happen when texting and driving. You may wonder if your teen is actually listening to you, or whether they are just nodding and acknowledging just so that you will stop talking and leave them alone.

If you need another example of the dangers of texting and driving, you can point out the situation Bruce Jenner is in following a collision on California’s Pacific Coast Highway (Highway 1). According to a number of media reports, Jenner rear-ended a Lexus that hit a Toyota Corolla that had stopped on the highway. The impact sent the Lexus into oncoming traffic, where it was hit by a Humvee.

The woman driving the Lexus was killed. The people riding in the Humvee were not hurt seriously, and Bruce Jenner was also not injured. Whenever a crash involves a celebrity in Southern California, paparazzi are suspected. However, there are no reports that photographers were pursuing Jenner. Also, authorities investigating the crash are attempting to obtain cell phone and text messaging records to determine if one of the drivers, particularly Bruce Jenner, was texting while driving.

This investigation is of particular importance because of the criminal and civil implications. From a civil standpoint, a traffic violation can be viewed as evidence that a driver did not use reasonable care, and that it was the proximate cause of the crash. This could leave the offending driver liable for the crash.
