When should I bring a lawsuit after a car accident?

With the summer driving season in full swing, we can expect more traffic on Wisconsin’s freeways and interstates. We noted in a previous post how dangerous this time of year can be for young drivers; but the reality is that any time of year can be treacherous for those who  do not use reasonable care while behind the wheel.

For those who have been in accidents; especially those occurring during the winter months, it is important to know about the time frame allowed for bringing a lawsuit to garner compensation. This time frame (or time limit) is known as the “statute of limitations.” Essentially, if an accident victim does not bring a lawsuit within this time frame, they may lose the right to sue for damages.

Why do statutes of limitations exist? The basic answer is that it would be patently unfair to hold a potential defendant liable for such a long time (or in perpetuity) for an accident that could be resolved very quickly. With that, an accident victim must bring a lawsuit for damages within three years of the accident.

Indeed, statute of limitations does not prohibit one from taking steps to secure a settlement without the need of a lawsuit. Parties to an accident can reach an agreement regarding payment of damages through their respective insurers or on their own; and these agreements could be final and binding. However, through the process of reaching such an agreement, it is prudent to have an experienced attorney being part of the process.
