Why drunk driving matters in car accident cases

A number of weeks ago, we posted on the potential dangers for drivers during the Thanksgiving holiday. Fast forward to the week of Christmas, and these same dangers may return. Travelling during the week of Christmas may be especially dangerous given that the weather patterns that have come through our region could leave roads icy in some areas.

But even more troubling is the potential for additional drunk drivers on the road. Indeed, law enforcement agencies across western Wisconsin will be on alert for impaired drivers, and there will likely be additional patrols so that drunk drivers can be taken off the road before something tragic occurs.

After all, drunk driving accidents, especially during the holiday season, have a substantial and unique effect on public sentiment, so it is understandable that additional patrols may be seen on Wisconsin roads. Of course, there are criminal implications for driving with a blood alcohol level of .08 or above, but there are civil consequences as well.

In the event of an accident, a criminal conviction could be viewed as a evidence as a person’s failure to use reasonable care while operating a motor vehicle, and that such a failure was the proximate cause for an accident. This could also lead to a driver being held liable for an accident.

With that said, if you have been in an accident, it is prudent to conduct an investigation and learn about the facts and circumstances that led to a crash. An experienced personal injury law firm can to this.
