Toyota issues recall due to seatbelt recall

If there is one thing that auto safety advocate insist that drivers do once they get in their vehicles, it is that they put on their seatbelts. Using seatbelts are arguably the best way to survive a crash, as the likelihood of you being severely injured (or killed ) increases dramatically if you do not wear your seatbelt.

As importance as seatbelts are, the latest recall announced by Toyota is palpable. The Japanese automaker is recalling nearly three million of its RAV-4 SUVs because of a defect that could cause seatbelts to fail in a crash. According to a recent ABC News.com report, Toyota discovered that seatbelts in both second row window seats could come in contact with the vehicle’s seat cushion frame in frontal crashes. If that occurs, the seatbelts could be severed; thus preventing occupants from being restrained.

As we have noted in prior posts, automakers have a continuing legal duty to take reasonable steps to remedy defects that put customers at risk of severe harm. If an automaker fails to adhere to this duty and an accident occurs due to the defect, the automaker could be held liable for the injuries that occur.

In the meantime, Toyota announced that it will replace the metal cushion frames with plastic frames to address the issue. The change will be completed at no charge to customers.

While this is an example of an automaker staying on top of defects, not all automakers act prudently. If you have been injured in a crash due to a defect, an experienced personal injury attorney can advise you.
