Potential of wrongful death case after fatal multi-vehicle crash

If a driver causes an accident, it may be proven that he or she exhibited negligent behavior. Unfortunately, this negligence may result in the death of someone involved in the accident. In these cases, survivors often pursue wrongful death claims to help them offset costs and other damages they have incurred. However, what happens if the driver who caused the accident dies as well? A Wisconsin family recently experienced this situation.

An 84-year-old man was driving north on Highway 47 near Bonduel in a sedan. A semi-truck driven by a 61-year old man was also traveling in that direction. The driver of the sedan attempted to pass the semi when he crashed head-on into a compact car operated by a 57-year old man.

The Wisconsin State Patrol reports that the drivers of both cars were killed in the collision. An 81-year old passenger in the sedan was transported to a local hospital with life-threatening injuries. The driver of the semi was not injured. All drivers and passengers were wearing seat belts.

Though a lawsuit can never bring back a lost loved one, a successful wrongful death claim often helps families deal with their loss. Families are typically faced with funeral expenses and other costs associated with the accident. They may also seek damages for loss of potential earnings and for their mental anguish and suffering. When unable to file a lawsuit against the driver who caused the accident due to his or her death, Wisconsin families have the right to file a claim against the driver's estate. An experienced personal injury attorney may help survivors pursue a favorable outcome in a similar lawsuit.
